These Terms govern your use of our website konquermediaagency.com and apply to any services you engage us for unless a signed Service Agreement says otherwise. Where a signed Service Agreement conflicts with these Terms, the Service Agreement prevails.

Booking a brief through our website is an expression of interest — it is not a contract. A binding engagement is formed only when both parties sign our Media Services Agreement (or accept written terms in an email exchange that clearly identifies scope, price and start date).
Prices displayed on this website are indicative, in Australian dollars, exclusive of GST unless stated otherwise.
Our services are offered on a monthly retainer basis with a three-month minimum term. After the minimum term, retainers continue month-to-month until either party gives thirty (30) days' written notice.
Full terms, including intellectual property assignment on payment, raw file retention (12 months), advertising spend arrangements and termination rights, are set out in the Media Services Agreement you sign when you engage us.
Prices are in Australian dollars (AUD) and exclude GST unless stated otherwise. GST is charged at the rate set under the GST Act. Tax invoices are issued in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Payment terms are seven (7) days from invoice date unless the Media Services Agreement specifies otherwise.
Where your retainer includes managed Meta or Google advertising, any ad spend up to the bundled amount in your retainer is paid by us to the platform on your behalf. Optional additional ad spend above the bundled amount is paid by you directly to the platform via partner-agency billing, passed through at cost with no markup from us.
Nothing in these Terms, or any agreement we enter with you, excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
To the extent permitted by law, our liability for breach of a consumer guarantee in respect of services (other than services ordinarily acquired for personal, domestic or household use) is limited to, at our option, supplying the services again or paying the cost of having the services supplied again.
Our services are professional media production and advertising services. While we apply due care and skill consistent with industry standards, we cannot guarantee specific outcomes such as a minimum number of leads, sales, followers, impressions or cost-per-lead. Advertising platforms (Meta, Google and others) set their own policies, approval rules and pricing beyond our control.
To the maximum extent permitted by law, and subject to clause 8, our total liability arising from these Terms or your use of our website is limited to AUD $100. Liability in respect of our services under a Media Services Agreement is limited as set out in that Agreement.
Neither party is liable for indirect, consequential, special, incidental or punitive loss — including loss of profits, revenue, business opportunity, goodwill or data.
We handle personal information in accordance with our Privacy Policy, available at konquermediaagency.com/privacy.
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates the most recent revision. Material changes will be announced on this page.
These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
